(1) Consumers have a thirty-day right of revocation.

Right of Revocation

You have the right to revoke this contract within thirty days without giving reasons.

The revocation period is thirty days from the day on which you or a third party named by you who is not the carrier have taken possession of the last goods. In the case of digital content that is not delivered on a physical data carrier (e.g., CDs or DVDs) but is made available for download, the revocation period is fourteen days from the date of conclusion of the contract.

In order to exercise your right of revocation, you must inform us (PocketBook Readers GmbH, Richard-Wagner-Str. 11, 01445 Radebeul, phone: +49 (0) 351 79556300, fax: +49 (0) 351 79556320, e-mail: [email protected]) of your decision to withdraw from this contract by means of a clear declaration (e.g., a letter sent to us by post, fax or e-mail). You can use the attached sample revocation form, which is not mandatory.

In order to comply with the revocation period, it is sufficient that you send the notification of exercising the right of revocation before the expiry of the revocation period.

 

Consequences of Revocation

If you revoke this Agreement, we shall reimburse you immediately and no later than fourteen days from the date on which we received notice of your revocation of this Agreement for all payments we have received from you, including delivery charges (other than additional charges arising from your choice of a method of delivery other than the cheapest standard delivery offered by us). We will use the same means of payment used by you in the original transaction for such refund, unless expressly agreed otherwise with you and in no event will you be charged for such refund. We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.

You must return or hand over the goods to FixIT c/o ZAK, Rauschwalder Straße 41, 02826 Görlitz, Germany immediately and in any case within fourteen days of the day on which you notify us of the revocation of this contract at the latest. This period shall be deemed observed if you dispatch the goods before expiry of the period of fourteen days. We shall bear the costs of returning the goods if you use the return label provided by us for return shipment within Germany. You receive the return label if you click on www.pocketbook.de in your personal area on "My orders", click there on the button "Return article" and follow the further instructions. Otherwise you will have to bear the costs of the return shipment.

You shall be liable for any depreciation of the goods only if such depreciation is due to handling the goods beyond the necessary extent to examine their nature, property and functionality.

 

(2) The right of revocation does not exist,

-     In the event of goods supplied which are not prefabricated and the manufacture of which is determined by an individual choice or designation made by the consumer or which are clearly tailored to the personal needs of the consumer,

-     in the case of delivery of sound or video recordings or computer software in a sealed package, if the seal has been removed after delivery.
